firewire 410 windows 7

Ive found a few threads with this but there were all locked.
ive got a gigabyte ep45-ud3r motherboard with onboard TI compliant chipset firewire ports. Since i bought my firewire card years ago ive never gotten it to be powered by the 6pin firewire cable and need to use the adapter to give it power. It always worked fine with XP but when i updated to win7 the audio got randomly crackly. It will come and go and sometimes switching windows audio properties from 24 bit to 16 bit or vice versa sometimes resets the audio and the audio clears up. the chipset is TI, the IRQ isnt conflicting with my videocard. the only things on (pci) 0x00000017(23) are two listings of USB controlers and the TI 1394 OHCI compliant host controller. Ive got the last driver which was released for the firewire410. all i would like is for the crackeling to stop. never did it in winXP so i know its not the hardware.
